Japan: Japan Ratifies Nagoya-Kuala Lumpur Supplementary Protocol

On December 5, 2017, the Government of Japan (GOJ) ratified the “Nagoya-Kuala Lumpur Supplemental Protocol on Liability and Redress to the Cartagena Protocol on Biodiversity” (the Supplemental Protocol). The Supplemental Protocol requires that response measures be taken in the event of damage to biodiversity resulting from living modified organisms (LMO), or where there is sufficient likelihood that damage will result if timely response measures are not taken. Prior to the Supplemental Protocol, there was no mechanism that would allow the State to make a legal claim against an overseas stakeholder for the recovery of damages when a transboundary LMO causes harm to local biodiversity. After it submitted its letter accepting the Supplemental Protocol to the Secretary General of the United Nations, Japan became the 40th party to formally ratify the Supplemental Protocol (which is expected to enter into force on March 5, 2018).
